MDS has experience in several aspects of litigation arising out of the Employee Retirement Income Security Act, also known as ERISA. MDS attorneys have represented plan sponsors in benefit claims litigation, serving as lead or local counsel. MDS has successfully obtained summary judgment and appellate rulings dismissing benefit claim lawsuits and has been involved in resolving benefit claims during the administrative process. MDS attorneys have also served as counsel to multiemployer welfare benefit plans and as trustee to the Montana state bar health care plan.
